The mother was taken to a nearby hospital with possible serious injuries.

According to 9news.com, the Colorado State Patrol (CSP) does not suspect drugs or alcohol were factors in the crash and indicated that while the child was in a safety seat, it was most probably not properly restrained.

Attorney Robert J. Anderson extends his deepest sympathy to the injured mother and her family facing the terrible consequences of this tragedy.

Colorado drivers are reminded by the CSP that more than 90% of the child safety seats inspected by the Child Passenger Safety Team Colorado were improperly installed or used.

Colorado Springs auto accident attorney Robert J. Anderson also wants to stress the importance of the new law on child passenger safety, requiring as of August 1, 2010 that all children under age 8 be properly restrained in a child seat or booster. Previously, the law required only children up to 5 years of age to be seated in safety seats.

Many children die every year in Colorado vehicle accidents because their low body mass and small size makes them particularly vulnerable to projection and ejection. The only way to keep a small child safe in a car is to restrain it tightly to a child safety seat and have the seat anchored onto the car seat in a way that will resist the strongest impacts.
http://www.lawrja.com/news/9monthold%2Dchild%2Dejected%2Dand%2Dkilled%2Din%2Di70%2Dcar%2Drollover%2Dmother20100902%2Ecfm http://www.lawrja.com/news/9monthold%2Dchild%2Dejected%2Dand%2Dkilled%2Din%2Di70%2Dcar%2Drollover%2Dmother20100902%2Ecfm blog@www.lawrja.com (news Author)17461 Thu, 02 Sep 2010 08:00:00 EST Despite very strict FMCSA regulations, truckers are still the main cause of truck accidents in Colorado.
We all know that airline pilots are subject to strictly enforced regulations regarding training, qualifications, maximum work time, compulsory rest periods, alcohol and drug use, etc. For many years the Federal Motor Carrier Safety Administration (FMCSA) has enforced similar rules for truckers, aware of the terrible damages that could result from a truck driver's poor judgment or loss of control.

Truck safety in Colorado and on America's highways has improved over the years, even if 2008 figures still show that 4,229 people have died and some 90,000 people have been injured in truck accidents. Facing these impressive numbers, Coloradans may have a right to know what causes so many accidents.

A recent study conducted by the FMCSA over a three year period has shown that fifty-five percent of all accidents involving a truck were caused by the truck. More to the point, forty-eight percent of all truck accidents were caused by a truck driver error, whether the truck driver fell asleep, lost consciousness, was distracted or inattentive, was speeding, tailgated or lost control.

Having passionately and successfully defended the rights of hundreds of Colorado victims of truck accidents, attorney Robert J. However, the car’s interior insulates those envious drivers not just from noise, smells, and climate, but also from the devastating effects of a crash.

Not being protected in the event of an accident is in itself a good reason for a Colorado motorcyclist not to drink alcohol. Cutting right in front of a truck at 70 mph and braking to catch the next exit is sheer madness. A truck needs a lot of time and a long distance to reduce its speed and come to a standstill. A truck crashing into a car can be devastating because of the truck's weight, which can be as much as twenty times the weight of a car, and heavy steel construction, which makes the truck an unstoppable and deadly force. Car drivers may assume that the trucker sees them coming, but most of the time this is not the case. The trucker is not surrounded by glass panels, and a truck's external rear-view mirrors cover only a small part of the fifty-two-foot-long sides.

But Colorado truck crashes are also caused by truckers and by trucking companies. The regulations enforced by the Federal Motor Carrier Safety Administration are numerous and stringent. They cover a wide range of topics, including truck size and weight, inspection frequency, maintenance and repair, truck safety standards, safety parts and accessories for operation, drivers' qualifications, training and licenses, truckers' service and rest hours, drug and alcohol tests, and many more.

Studies have shown that violations of these expensive and cumbersome rules are widespread. A transport company operating thousands of trucks deals with crashes almost daily, and knows precisely what to do after a crash to minimize their exposure to litigation. If you or someone you care for has been the victim of a Colorado auto accident with a truck, make sure you contact a legal adviser who has a lot of experience in dealing with trucking companies and their insurers.

Colorado Springs Personal Injury Attorney Robert J. But as Colorado Springs car crash lawyers, we have seen too many people regret their failure to do what was necessary to prevent a bad situation from getting worse. What needs to be done, and in what order?

1. Assess the situation: Identify injured people, danger from oncoming traffic, leaking gas, etc. Decide where to start.

2. Protect the accident scene: Make sure nobody gets hit by a passing vehicle and approaching cars don't ram into the accident scene.

3. Help the injured: Call 911 if anyone is badly hurt, and help the injured, but don't try to move anyone who seems to have severe back or head injuries.

4. Get a police report: This will help you afterward. Ask for the responding officer's name and phone number, and tell him you want a copy of the police report when one is available.

5. Write your own description and notes: To be sure you remember, write down: the cause of the accident, injuries, damages, and the names and contact information of any witnesses. Fill out your accident form. Take pictures before the vehicles are moved.

6. Don't say or agree to anything: Don't settle anything on the spot, even if the other driver makes you a generous offer. Do not apologize or say anything to imply that you were at fault. Wait and take your time to get back on your feet first.
http://www.lawrja.com/blog/colorado%2Dsprings%2Dauto%2Daccident%2Dattorney%2Ddenver%2Dserious%2Dcar%2Dcrash%2Ecfm http://www.lawrja.com/blog/colorado%2Dsprings%2Dauto%2Daccident%2Dattorney%2Ddenver%2Dserious%2Dcar%2Dcrash%2Ecfm rja@lawrja.com (blog Author)36677 Wed, 04 Aug 2010 08:00:00 EST Keep your distance from aggressive drivers in Colorado
An angry person behind the steering wheel is a disaster waiting to happen. Many Colorado auto accidents are caused by drivers who are nervous, reckless, and aggressive.

Aggressive drivers can be scary, so the best you can do is stay away from them. Make sure everyone is buckled up, lock your doors, do not react to provocation, and do not respond to or look at the angry driver. If you are being harassed, don't go straight home, but drive to a police station or a crowded place.

In May 2010 the State of Colorado signed a bill increasing the penalties for careless driving resulting in death. But careless driving is merely a traffic violation, whereas aggressive driving-sometimes called "road rage"-shows intent to harm.

This is one reason why the Colorado State Patrol (CSP) has set up a hotline allowing drivers to report aggressive driving. It is important for witnesses to describe the aggressive driver's behavior. If the driver shows intent to harm, he can face much harsher penalties. The CSP aggressive driving hotline is *CSP, or *277.

We are all prone to becoming more aggressive in a car. It may have something to do with the confined space of a car, or the necessity of tolerating other drivers. It will probably deflate the anger of others, and it will even soothe your own frustrations. Try it.

Colorado Springs Personal Injury Attorney Robert J. Driver inattention is worst when the driver has 1) his eyes off the road, 2) his hands off the wheel and 3) his mind focusing elsewhere. According to the US Government web site on distracted driving, these most dangerous sources of distraction cause the worst crashes because it takes so much time to bring the driver's eyes, hands, and mind back to driving. The mind is the key: when you read an e-mail, you don't count the seconds that your eyes are off the road,; you just go from one line to the next and don't realize the growing danger.

Drinking your coffee and talking on the phone are not as dangerous, as in the first case your mind can focus on the driving, and in the second, one hand is on the wheel and your eyes are on the road. But these examples also show how relative these risks are. It may be OK to drink coffee or talk on the phone on a straight, low-traffic highway, but it is not the same on the Denver Mousetrap Interchange. Drinking very hot coffee is no problem until you spill some on your bare knees. Talking on the phone is OK until the discussion heats up, tempers rise, and a red light is crossed while you are exchanging nasty epithets.

If you or a loved one have been injured in a motorcycle, truck, or car accident caused by a distracted driver, call Vehicle Accident Attorney Robert J. We all feel we shouldn't do it. Like driving at 110 mph or getting behind the wheel after a few margaritas. But it is only recently that federal and state bans on driving while texting have been implemented, the Colorado ban has only been in effect since December 2009. There is a very good reason for banning reading, typing, and sending text messages while driving: you can't do it without taking your eyes off the road. A recent study by the Virginia Tech Transportation Institute has shown that while texting over a six-second period, the driver's eyes are away from the road for 4.6 seconds. This is equivalent to crossing the length of a football field at 55 mph with your eyes shut!

The study concludes that the crash risk posed by driving while texting is twenty-three times higher than for a non-distracted driver. So, yes, texting should be banned. Assessing the offense is not as difficult as you might think, or at least no more so than assessing DUI. The Colorado law makes driving while texting a primary offense, meaning the officer can stop a driver if he thinks he is texting, and the driver's cell phone will indicate the exact time a message was sent or received.

Colorado victims of accidents distracted driving certainly hope for an increased awareness of the terrible consequences of driving while texting. When it comes to buying a new car in Colorado, we tend to look at all its bells and whistles. Is there an mp3 outlet? How about a navigation system? Are there seat heaters? Then we’ll take the car for a spin and, ultimately, decide on the spot whether or not we are going to purchase it. While all these “toys” are nice to have in a new or used vehicle, what really matters most is what we’re not seeing – realistically, how safe is this vehicle?

When it comes to safety, there are two factors to focus on: how well a car maintains itself when in a Colorado car accident, and how it’s designed to keep the accident from happening in the first place. Vehicles are tested in crashes to see what their safety features are (like the number of air bags and air bag deployment). Some of what is measured is the vehicle’s braking systems, acceleration, position of the driver’s seat, and driver’s visibility.

According to Consumer Reports, the most important features in a vehicle are the safety factors, the quality of the vehicle, its value, and its performance. The second contributing factor was a hand-held wireless device. The findings also included inattention, distraction, and multitasking, among others.

The goal of this study is to improve driving safety and save lives since vehicle accidents in Colorado Springs and throughout the nation are the leading cause of injury-related death for people between the ages of 1 to 65 years old.

If you have been injured, contact a Colorado Springs car accident attorney at the Law Offices of Robert J.
